If your residence card (karta pobytu) is taking too long, Polish law gives you a formal remedy — a ponaglenie under art. 37 of the Code of Administrative Procedure (KPA). It is a complaint about inactivity or excessive length of proceedings: it is addressed to the higher authority (Head of the Office for Foreigners) and filed through the voivode handling your case, carries no state fee, and obliges the higher authority to assess the delay and set a deadline. USPI Work and Documents (Bydgoszcz, KRAZ 34438) analyses your case, checks whether the statutory deadline has passed, drafts and files the ponaglenie under a power of attorney, requests access to the case file (art. 73 KPA) and explains the authority’s reply. The decision on the card is taken only by the voivode — it cannot be sped up or guaranteed by any date.

Ponaglenie: a formal complaint when the office exceeds its deadline
Residence card applications are often delayed for many months. The Polish Code of Administrative Procedure (KPA) sets binding deadlines: one month for a standard case, two months for a complex one. If the authority exceeds them without notifying you of a new date, you are entitled to file a ponaglenie — a formal complaint about inactivity or excessively lengthy proceedings.
A ponaglenie is addressed to the higher-instance authority (for residence cards, the Head of the Office for Foreigners) but filed through the office handling your case. That office must forward it together with the case files within seven days.
A ponaglenie is not “paid acceleration” and not a guarantee of a positive decision. It is the statutory way to have the higher authority formally assess the delay and set a deadline for handling the case.

What is a ponaglenie?

When can I file a ponaglenie for my residence card?
+Once the statutory deadline has passed, or the authority has missed a deadline it notified you of itself. The general KPA deadlines are 1 month (2 months for complex cases); for residence cards the Act on Foreigners sets 60 days for a temporary residence permit (counted from the moment the case is complete: application, fingerprints, remedied deficiencies) and 6 months for permanent residence and EU long-term resident permits. A ponaglenie filed too early is left without examination.
Does a ponaglenie guarantee a positive decision or a specific date?
+No. A ponaglenie concerns only deadlines, not the content of the decision. The higher authority assesses whether there was undue delay and sets a deadline. The decision itself is taken solely by the state authority — USPI does not influence it and does not promise any dates.
How much does it cost to file a ponaglenie?
+There is no state fee for a ponaglenie — you can file it yourself, free of charge. The cost of USPI’s assistance (case analysis, drafting, filing under a power of attorney, monitoring the reply) is fixed in the contract before we start — ask our manager.
What happens after filing?
+The office handling your case must forward the complaint, together with the case files and its own position, to the higher authority within 7 days. That authority issues a ruling (postanowienie) within 7 days: it confirms or rejects the inactivity/delay, sets a deadline for handling the case if the complaint is justified, and may state a flagrant breach of law.
Can I file a ponaglenie myself?
+Yes. It is the right of every party to the proceedings and you may exercise it yourself, free of charge. USPI’s service is voluntary assistance: we check whether the deadline has passed, draft the complaint with references to the KPA and your case files, file it under a power of attorney (pełnomocnictwo) and explain the authority’s reply.
What if the ponaglenie does not help?
+The next step is a complaint about inactivity or excessive length of proceedings (skarga na bezczynność / przewlekłość) to the Voivodeship Administrative Court (WSA), filed through the authority after the ponaglenie.
